A financial settlement in divorce refers to the agreement reached between spouses regarding the division of assets, debts, and financial responsibilities after the marriage ends. While it is always favourable to reach an agreement through negotiation and mediation, it is sometimes the case that an agreement cannot be reached with regard to property or money, and it is in this situation that an application to the Court can be made - asking for a Judge to make a determination in the case. The Court can also make orders for maintenance, lump sums, and property adjustment in relation to any children in the marriage.
Even if you are able to reach a financial agreement through negotiation and mediation, and even if you are parting on amicable terms as a couple, it is vital to have your agreement put into a Court Order, expressed to be in “full and final settlement.” Without this, your former spouse can make financial claims against you at any time in the future.
