Our Fees - Licensing Applications

Scotts Hall & Birtles Solicitors are experienced in assisting clients with applications for new premises licences under section 17 of the Licensing Act 2003. We can offer a range of pricing structures depending upon the level of service you require and the amount and complexity of the work involved.

Please note that there will be two elements to the prices as set out below:

  1. Fees charged by Scotts Hall & Birtles Solicitors and

  2. Fees payable to third parties

Fees payable to Scotts Hall & Birtles Solicitors

* basis of charging = hourly rate of £250.00.Based on 5 - 10 numbers of hours to complete the work for a simple application. Based on 10 - 15 numbers of hours to complete the work for a medium complexity application. Based on 25 - 50 numbers of hours to complete the work for a high complexity application.

Factors that affect the complexity of an application:

  • Whether there is a cumulative impact policy in place.

  • The type of and size of the premises.

  • Whether the premises are in a residential area.

  • What the premises will be used for e.g., premises intended to be used for large scale public events would significantly increase the complexity of an application.

 

We will be able to give you an idea of which application type you are likely to have once we receive details of your application from you.

 

Fees payable to third parties (‘disbursements’)

Application Fee

This is based in the domestic rateable value of the premises and varies from £100.00 to £650.00 per application. An additional multiplier sum may be added to this if the premises is to be used exclusively or primarily for the sale of alcohol consumed on premises.

 

Annual Charge

 

There is an annual licence renewal fee for each year the licence is required, again this is based on the rateable value of the business and can range from £70 to £400 per year. An additional multiplier sum may be added to this if the premises is to be used exclusively or primarily for the sale of alcohol consumed on premises.

 

Advertising /Enquiry Agent Fees

 

Notice of your licence will be publishes in the local newspapers. Fees range from between £200.00 to £750.00 plus VAT (at 20% £40 to £150) depending on the length of the notice. If we are required to instruct an enquiry agent to place you notice, these fees can be in the range of £200.00 to £400.00 plus VAT (at 20% £40 to £80).

 

We will be able to advise you in more detail once we understand your individual circumstances.

 

Work included and key stages

 

The precise work and stages involved in a licensing application vary according to the circumstances. However, we have set out the key stages involved in a typical application:

  • Taking your instructions and advising you as to how you can promote the licensing objectives within your application.

  • Advising you as to the type of plans you are required to submit with your application.

  • Completing the application form for the licence in accordance with your instructions and submitting this to the local licensing authority alongside suitable plans. You must provide suitable plans.

  • Providing guidance on the fee levels payable to the licensing authority.

  • Preparing copies of the premises license application for disclosure to the responsible authorities and serving copies of the application on the responsible authorities.

  • Drafting the notices advertising the premises licence application and submitting the notice to the local newspaper.

  • Arranging with you for you to display the notice(s) advertising the premises license application and advising as to where and how this should be done by you in order to comply with the requirements of the Licensing Act 2003.

  • Providing a Designated Premises Supervisor (DPS) consent form for signature by a personal licence holder proposed by yourself.

  • Checking the licence once granted and correcting any errors with the licensing authority.

 

Services excluded

Our service will not include any of the following:

  • Obtaining suitable plans.

  • Attending pre-consultation meetings with the Licensing Authority or Responsible Authorities, nor their fee for this meeting.

  • Dealing with or advising you in relation to queries or representations received from either the responsible authorities or other interested parties.

  • Advising on varying the license.

  • Attendance and representation at a licensing sub-committee hearing of the responsible authority. If representations are received and attendance and representation at a licensing sub-committee is required, then we will provide a separate fee estimate for this work.

 

Approximate/ average timescales

 

Simple licensing application matters usually take up to one month from receipt of full instructions from you to submit the application. This is on the basis of the application being relatively straightforward and you being able to provide all the necessary documents promptly. If your matter is more complex, for example, if there is substantial opposition from interested parties, or if there is a delay in receiving the documents we need, it may take longer.
