Don't plan to fail
Are you embarking on a commercial project that involves planning? Are you unsure whether your project will need planning permission at all? Are you required to enter into a planning agreement? Are you struggling with planning enforcement?
Most people are familiar with the concept of planning permission, but it is vital to seek expert advice, specifically when carrying out commercial development. Without it, large costs and delays may be incurred.
Just as with residential properties, commercial properties require planning permission for property development, re-developments, and large extensions. Exceptions exist, but they depend on such a wide range of variables that it is advisable to seek guidance.
Commercial properties also require planning permission for change of use. Categories of use can be broad, which means that small adjustments to use may keep the property within the same category – but permission must be sought for bigger changes.
Decisions on planning applications take at least eight weeks, and successful applications remain subject to challenge for six weeks after permission is granted. This means that work should not begin immediately upon receipt of consent. If you are found to have breached planning laws, the Local Authority can order that works cease, and that the building be returned to its original condition – giving rise to large costs and delays for the property owner or developer.
